TenDlite® video testimonial contest (the “Contest”) is open only to legal residents of the fifty (50) United States (and the District of Columbia), who are 18 years or older at time of submission by signing up at http://tendlite.myshopify.com/pages/contest. No purchase is necessary to enter or win. A purchase does not increase the chances of winning. Participants submitting videos must have a valid email address. Videos must adhere to “Terms and Conditions” to be eligible to win a prize. Participation in this Contest constitutes Participant's full and unconditional agreement to these “Terms and Conditions” and Lumina Group Inc.’s decisions, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
The Contest is not open to Employees of Lumina Group Inc, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees. The Contest is subject to all applicable federal, state, and local laws and regulations.
Participant’s video must fulfill all Contest requirements as specified in “Terms and Conditions”. Participants may enter only once. Entering more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules may lead to removal from eligibility at the sole discretion of Lumina Group Inc.
Entries will be accepted online starting on [start]. A new Contest will be held monthly. Each month there will be a new “First Prize” winner. All online entries must be received by [end]. TenDlite®’s website database clock will be the official time keeper for this Contest. Each month Lumina Group Inc., the owner of TenDlite®, will award a $10 Amazon.com® gift card to all approved videos meeting eligibility. The highest rated videos (“First Prize”) will win a $200 gift card to Amazon.com®. Winners will be notified through the email address submitted with their entry. If a potential winner does not respond within the timeframe stated in the notification email, Lumina Group Inc. may select an alternate potential winner. Acceptance of any prize shall constitute and signify winner’s agreement and consent that Lumina Group Inc and its designees may use the winner’s, name, city, state, likeness, photo, submission and/or prize information in connection with the Contest for promotion. Lumina Group Inc. reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion.
No cash or other prize substitution shall be permitted except at Lumina Group Inc.’s ,the owners of TenDlite®, discretion. The prize is nontransferable. Any and all prize-related expenses, including, without limitation, any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Lumina Group Inc. to use Winner’s name, likeness, and video submission for purposes of advertising and trade without further compensation, unless prohibited by law.
Video must be 30 to 50 seconds long and clearly show Participant’s face and TenDlite® product as well as clearly mention TenDlite® name and Participant’s experience with TenDlite®. Video must be original, unpublished, and the sole property of submitter. Multiple entries are not allowed. Submissions received from any person, fan, or email address in excess of the stated limit will be void. Participants may only participate in one contest.
Participants must have written permission from any identifiable person who appears in, is heard in, or otherwise contributed to the video submission (a “Participant”). If a Participant is a minor, parent/legal guardian must grant written permission. Participants must pass along all rights for usage to Lumina Group Inc. the owners of TenDlite®. Each Participant must agree to sign a form and provide such release to Lumina Group Inc. as requested.
The video must NOT include unsuitable content or depict or incorporate: unsafe behavior or situations, obscenity, disparagement of any product or person, or other offensive conduct or material, or otherwise include inappropriate, illegal, or unethical content. Submissions may not contain: obscenities; crude, vulgar or offensive pictures, depictions, images, language and/or symbols; violence; explicit sexual activity; nudity; illegal drug or alcohol use; unauthorized trademarks and copyrighted materials; license plates, phone numbers, personal addresses (physical or electronic mail); derogatory characterizations of any ethnic, racial, sexual, gender, ageist, political, religious or other groups of individuals; illegal conduct, behavior or activity; any other content, display, materials and/or images that is or could be considered inappropriate, offensive, or unsuitable as determined by Lumina Group Inc. in its sole discretion.
Winner will be notified by email within five (5) days following selection of Winner. Lumina Group Inc. shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within [30 days ] from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT LUMINA GROUP INC.‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Employees of Lumina Group Inc. will judge eligible videos for “First Prize” and subsequent prizes for eligible submissions. Submissions will be judged based on originality, creativity, and content as outlined in “Terms and Conditions”. All decisions of the judges are final. Lumina Group Inc. reserves the right to pre-screen, monitor, and remove postings, all at its sole discretion. Entries that are judged by Lumina Group Inc. employees as being incomplete or not in adherence to the contest “Terms and Conditions” may be disqualified at the sole discretion of Lumina Group Inc.
By participating, Participants agree to be fully and unconditionally bound by these Rules. Participants represent and warrant that they themselves meet the eligibility requirements. Participants agree to accept the decisions of Lumina Group Inc. as final and binding as it relates to this Contest.
As a condition of participating in this Contest, Participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in relevant jurisdictions. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.
By entering this content (e.g., photo, video, text, etc.), Participants declare understanding and agreeing that Lumina Group Inc, anyone acting on behalf of Lumina Group Inc and Lumina Group Inc.’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Participant’s submission, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent. Optional verbiage for Contests: By entering this content, Participants represent and warrant that submission is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If Participant’s submission infringes upon the intellectual property right of another, Participant will be disqualified at the sole discretion of Lumina Group Inc. If the content of Participant’s submission is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, Participants shall, at their sole expense, defend or settle against such claims. Participants shall indemnify, defend, and hold harmless Lumina Group Inc. from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Lumina Group Inc. may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
Lumina Group Inc. reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Lumina Group Inc.’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Lumina Group Inc. may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Lumina Group Inc. Lumina Group Inc. reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the submission process or the operation of the Contest or website or violates these Terms & Conditions. Lumina Group Inc. has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest “Terms and Conditions”, the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Lumina Group Inc. reserves the right to seek damages to the fullest extent permitted by law. If the contest is not able to run as planned, without limitation, Lumina Group Inc. reserves the right to cancel, terminate, or modify the contest at Lumina Group Inc.’s discretion.
By entering, Participants agree to release and hold harmless Lumina Group Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the submission process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries. Lumina Group Inc. will not be held responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials, on the website and/or the in “Terms and Conditions”, the “Terms and Conditions” shall prevail, govern and control and the discrepancy will be resolved by Lumina Group Inc.’s sole and absolute discretion. Entrants must notify Lumina Group Inc. of all complaints or claims within [30 days] of the date of the end of the Contest. Failure to notify Lumina Group Inc. of a claim within these [30 days] days will constitute a waiver of any claims, actions, or damages.
